CLARIFICATION TEXT ON THE PROCESSING OF PERSONAL DATA
Definitions
KVKK: Law No. 6698 on the Protection of Personal Data
Personal Data: Any information relating to an identified or identifiable natural person/employee, including those in the personnel file, such as identity, address, telephone, e-mail, ID number, driver's license number, passport number, etc.
Protection of Personal Data: Pursuant to Law No. 6698 on the Protection of Personal Data (KVKK), any information that makes a natural person's identity specific or identifiable falls within the scope of personal data. As Saray OSB Mah. K3 Caddesi No:2/1-2-3 HAB OSB 06980 Kahramankazan /ANKARA/TURKEY, we would like to inform you regarding the purposes for processing your personal data described below, the legal grounds, collection methods, to whom and for what purposes it can be transferred, and your rights granted under the KVKK, either connected to or independent of these.
1. Data Controller and Categories of Personal Data
In accordance with the Law No. 6698 on the Protection of Personal Data ("Law No. 6698"); your identity information, contact information, information that may be included in the content of the message you send to us, marketing information, and transaction security information may be processed by Saray OSB Mah. K3 Caddesi No:2/1-2-3 HAB OSB 06980 Kahramankazan /ANKARA/TURKEY ("Company") as the data controller, within the scope explained below.
2. Methods of Collecting Personal Data
Your personal data is collected by the Company in the capacity of data controller, through written or electronic methods based on explicit consent, via the contact form you fill out on the website, based on our legal obligations arising from the KVKK and other relevant legislation, as well as relevant legislation, contracts, requests, and legal reasons arising and executed based on the rules of honesty to provide you with quality services and carry out our business activities within this framework. This includes your identity and contact information such as name-surname, telephone, e-mail, address, etc. contained in the contact form, and any personal data that may be included in the content of the message you send to us.
3. Purposes of Processing Personal Data
Your personal data collected within the scope of the contact form is processed strictly for the purposes of evaluating the messages you submit, fulfilling your requests, creating, processing, and concluding your request, meeting your information requests regarding our services, conducting communication activities, tracking requests/complaints, and executing service processes, depending on the request subject to the contact form.
4. Transfer of Personal Data
Your personal data is transferred to our group companies, business partners, suppliers, legally authorized public institutions, and private persons, provided that your explicit consent is obtained or under the conditions that "it is mandatory to process data for the legitimate interests of the data controller, provided that this does not harm the fundamental rights and freedoms of the data subject." Additionally, your personal data is transferred to our business partners, legally authorized public institutions, and private persons residing abroad, provided that your explicit consent is obtained or, without seeking your explicit consent, provided that they are located in safe countries/countries with adequate protection as announced by the Personal Data Protection Board.
As stated above, the Company may share your personal data only based on your explicit consent or within the framework of the security and confidentiality principles specified in Law No. 6698 and related legislation, provided that necessary precautions are taken domestically and abroad, for the execution of Company activities; with our business partners, business connections, and stakeholders due to the information technologies we use, domestic or foreign servers and the companies providing support for these servers, domestic/foreign persons and institutions from whom we receive physical server and/or cloud services, suppliers processing data on behalf of our Company, public institutions or organizations authorized by legal obligation to request this data, and other relevant authorities without limitation.
5. Source and Legal Reason
Your personal data collected from you electronically, in writing, or verbally through the website is collected and processed based on the legal grounds specified in Article 5/2-f of Law No. 6698, namely "it is mandatory to process data for the legitimate interests of the data controller, provided that this does not harm the fundamental rights and freedoms of the data subject," and your explicit consent specified in Article 5/1, strictly limited to the purposes specified in Article 3 of this text, to protect the rights and interests of the data subject, to provide rights and benefits to you for the establishment of a business relationship, to maintain and develop in-house Company activities, and to fulfill obligations arising from the legislation.
6. Application Procedures and Principles
As a data subject, you can submit your requests regarding your rights under Article 11 of Law No. 6698 by following the procedures and principles set forth in the Data Subject Application Form. You can submit your application via a message sent with a mobile signature or e-signature to our e-mail address info@metaltekkimya.com.tr by filling out the relevant form, or by making a written application with a wet signature personally or through a notary public to the address Saray OSB Mah. K3 Caddesi No:2/1-2-3 HAB OSB 06980 Kahramankazan /ANKARA/TURKEY using the relevant form. The Company will conclude your application free of charge as soon as possible and within thirty days at the latest, depending on the nature of the request. However, if the transaction requires an additional cost, a fee may be charged by the Company in accordance with the tariff determined by the Personal Data Protection Board.
Based on the information provided above, the Company will respond to the following requests of data subjects:
- To learn whether the Company processes personal data concerning them and which personal data is processed,
- To obtain information about the purposes of the processing activity,
- To know the third parties to whom the Company transfers personal data domestically or abroad,
- To request the correction of personal data in case they are processed incompletely or incorrectly,
- To request the deletion or destruction of personal data in accordance with the Law,
- To request notification of the transactions made to third parties to whom personal data has been transferred, in case of correction, deletion, or destruction of personal data,
- To object to the occurrence of a result against the person himself/herself by analyzing the processed data exclusively through automated systems, and
- To receive a copy of their personal data.
